HUGO BOSS FATHER’S DAY SWEEPSTAKES OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER.  A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. 

The HUGO BOSS Father’s Day Sweepstakes (the “Sweepstakes”) begins on June 4th on or about  8:00 A.M. (EST) and ends on June 25th 2021 on or about 11:59 PM (EST)  (“the Sweepstakes Period”) and is sponsored by Hugo Boss Retail, Inc., located at  55 Water Street, 48th Floor New York, NY 10019 (together with its U.S. Affiliates, “Sponsor”).

ELIGIBILITY:  The Sweepstakes is only open to individuals, who, at the time of entry: (1) are legal residents of the 50 United States or District of Columbia, and (ii) are at least 21 years old and the age of majority in their respective state of residence.  Corporations and other organizations are not eligible.  Employees, officers, directors, agents, representatives, licensees and vendors of Sponsor, their subsidiaries, affiliates and advertising agencies, and their immediate families (spouse, domestic partners, parents, children, siblings and their spouses/domestic partners) and individuals residing in the same household as such individuals are ineligible.  Void where prohibited by law.  The Sweepstakes is subject to all federal, state and local laws and regulations of the U.S. and is void outside the 50 United States and the District of Columbia and where prohibited by law.

ENTRY:   To participate, entrants must meet the eligibility requirements as stated in these Official Rules and may either (i) go to http: https://www.hugoboss.com/us/customer-service/promotions/promotions/promotions.html#ankerCustomerServices during the Sweepstakes Period and enter through the entry form; or (ii) visit any full price free standing HUGO BOSS retail location in the U.S. (excluding outlet, licensed partners and concession partners) and register via an iPad located at the front register (“Entrant(s)”) . Entrants may at times receive offers from Sponsor or from selected third parties.  If you do not want to receive these offers, please check or uncheck the appropriate box when you register or, if you are already registered, you may opt out of receiving special offers at any time by emailing your unsubscribe request to customerservice-us@hugoboss.com.. One entry per person during the Sweepstakes Period. If there is a dispute regarding the identity of an Entrant, Sponsor will award the prize to the authorized holder of the email account listed on the applicable entry form.  All Entrant information, including email address and name, is subject to Sponsor’s Privacy Policy. By entering to participate in this Sweepstakes, Entrants agree to be bound by these Official Rules, by decisions of Sponsor, which are final in all matters relating to the Sweepstakes, and by Sponsor’s Terms of Use https://www.hugoboss.com/us/information-on-rights/terms-of-use/terms-of-use.html and Privacy Policy https://www.hugoboss.com/us/about-hugo-boss/privacy-statement/privacy-statement.html. Any violation of these Official Rules may result in disqualification.

WINNER SELECTION/PRIZEThe winner will be determined by random drawing on or about June 30, 2021.  Potential winner will be contacted on or about June 30, 2021 by email.  All decisions of the Sponsor shall be final.

One Grand Prize will be awarded to the selected winner (“Winner”).  The prize consists of one pair of signed boxing gloves from Anthony Joshua + HUGO BOSS Shopping Spree valued at $1500 US Dollars

Odds of winning depend on the total number of eligible entries received. Total ARV of the Prize is approximately $2,400.00. The Prize may in part or in in its entirety, in Sponsor’s sole discretion, be replaced with a cash prize or with HUGO BOSS Gift Cards valued at $2,400 or if replacing only a portion with the designated value in these rules. All prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND.  No substitution, cash equivalent or transfer of prize permitted except at the sole discretion of Sponsor.  Any portion of the Prize not accepted by Winner will be forfeited.  Winner may not sell or transfer the Prize or any portion of the Prize.  No more than one Prize will be awarded.

Disqualification and the selection of an alternate winner by Sponsor will result from: (1) failure of Winner to execute, notarize and return an Affidavit of Eligibility/Prize Acceptance/Liability and Publicity Release (where legal) within ten days of the email notification from Sponsor, if requested by Sponsor; (2) failure of Winner to respond within ten (10) days after the email notification from Sponsor, or the return of the email notification or Prize as undeliverable; and (3) any other non-compliance with these Official Rules by Winner.  Winner is solely responsible for payment of taxes, if any, on the Prize and for any other costs, fees or expenses relating to the use or enjoyment of the Prize not specified herein.  Winner  may be asked to supply Sponsor with their social security numbers for tax purposes.  An IRS Form 1099 may be issued in the name of Winner, for the actual value of the Prize received.  Winner shall solely bear all risk of loss of the Prize. By accepting the Prize, Winner automatically consents and grants to Sponsor the unconditional right to use his/her name, address (city and state only), likeness, photograph and/or statements about the Sweepstakes for publicity and advertising purposes without further permission or financial compensation, in any and all media now or hereafter devised worldwide, in perpetuity,  except where prohibited by law.  For a list of winners, send a self-addressed, stamped envelope to: Hugo Boss Retail, Inc.  HUGO BOSS Father’s Day Sweepstakes, 55 Water Street, 48th Floor New York, NY 10019 after June 1, 2018, but before July 15, 2018. Vermont residents may omit the return postage.

LIABILITY:  Sponsor is not responsible or liable for incorrect or inaccurate information in the entry form, whether caused by Entrant, equipment or programming utilized in the Sweepstakes or technical or human error in processing submissions.  Sponsor disclaims responsibility or liability for: (i) the accuracy, availability or timeliness of information published about the Sweepstakes; (ii) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of entries; (iii) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible entries; (iv) any injuries, losses or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize or from participation in the Sweepstakes; (v) printing or typographical errors in Sweepstakes materials; or (vi) problems or technical malfunctions of telephone networks or lines, computer online systems, servers or providers, computer equipment, software, Internet congestion.

If, for any reason, the Sweepstakes is not capable of running as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor may cancel, terminate, modify or suspend the Sweepstakes at its sole discretion. Sponsor is not liable for changes or cancellations to Event or any portion thereof. In the event of termination, winner will be selected from eligible entries received prior to termination.

RELEASE: Each participant releases and agrees to hold harmless Sponsor and its subsidiaries, affiliates, directors, officers, employees and agents from liability for claims, costs, injuries, losses or damages arising out of or in connection with the Sweepstakes or acceptance, possession or use and enjoyment of the Prize (including, without limitation, related to personal injury, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort, warranty or other theory.  Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery or use and enjoyment of the Prize.

CONDITIONS:  Entrants agree to use any materials or information procured as part of the Sweepstakes only for Sweepstakes purposes and not for any commercial purpose. All entries, and all rights to use, reproduce, publish, modify and distribute such entries become the exclusive property of Sponsor and will not be returned.    Sponsor reserves the right, at its sole discretion, to refuse any entry or disqualify any individual it finds to be:  tampering with the entry process or the operation of the Sweepstakes; acting in violation of these Official Rules; or acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.  CAUTION:  ANY ATTEMPT BY A PARTICIPANT OR OTHER PERSON TO UNDERMINE THE OPERATION OF THE SWEEPSTAKES OR COMMIT ANY OTHER ACT OF FRAUD MAY VIOLATE FEDERAL AND STATE CRIMINAL AND CIVIL LAWS.  SPONSOR RESERVES THE RIGHT TO DISQUALIFY ANY SUCH PARTICIPANT AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

LAW AND JURISDICTION: This Sweepstakes shall be governed by, and construed in accordance with the laws of the State of New York without regard to its rules governing conflicts of law. All participants and their heirs and assigns, consent to the jurisdiction of the federal and state courts in New York County, New York for all legal proceedings relating to this Sweepstakes.

If you are using BOSS UNBOXED in the United States, the below terms apply.

US Terms of Use

The MY HUGO BOSS EXPERIENCE BOSS UNBOXED PROGRAM (“BOSS UNBOXED”) is a MY HUGO BOSS EXPERIENCE benefit offered to select MY HUGO BOSS EXPERIENCE members in the United States. The program is run by HUGO BOSS Fashions, Inc. (“HUGO BOSS”, “we”, “us”, “our”)  and allows MY HUGO BOSS Experience members to schedule a virtual appointment with one of our in store associates and select curated products the total order amount capped at $1,000 US including sales tax (“Products”) for in home delivery for you to select and finalize your purchase at home. The following terms of use (the “Terms of Use” or “Terms”) form a binding agreement between you and us, and govern your participation in BOSS UNBOXED and your use, return and purchase of Products in connection therewith (collectively, the “Services”). 

These Terms of Use are subject to and incorporate by reference the Hugo Boss Terms and Conditions and the HUGO BOSS EXPERIENCE Terms and Conditions.    If there is any conflict between the foregoing documents and these Terms, the Hugo Boss Terms and Conditions will control, followed by the HUGO BOSS EXPERIENCE Terms and Conditions, followed by these Terms .

By participating in BOSS UNBOXED including but not limited to setting up an appointment, selecting Products,  purchasing Products, using the Services, or otherwise indicating your assent to these Terms, you agree to be bound by these Terms of Use and you represent and warrant that (1) you have read, understand, and agree to be bound by these Terms, (2) you are of legal age to form a binding contract with us, and (3) you have the authority to enter into the Terms (on behalf of yourself or the entity that you represent). If you do not wish to be bound by these Terms of Use for the BOSS UNBOXED program, you may not access or use the Services.

These Terms of Use are subject to occasional revision. We will notify you of any changes to our Terms of Use by posting the new Terms of Use on the Hugo Boss website with the effective date. If you have a BOSS UNBOXED order in process on the date the change is effective, the version of the Terms in effect on the date you reserved the purchase on your credit card shall apply. At our discretion, we may also (but shall not be obligated to) notify you of certain changes by sending you an email to the email address associated with your MY HUGO BOSS EXPERIENCE account. You are responsible for keeping your e-mail address current in your MY HUGO BOSS EXPERIENCE profile which can be found here https://www.hugoboss.com/on/demandware.store/Sites-US-Site/en_US/Account-RequireLogin by logging onto your account. Changes to these Terms of Use will be effective thirty (30) calendar days following our posting of the changes on our website. Continued use of the Services, including purchasing Products from us, following such changes will indicate your acknowledgement of such changes and agreement to be bound by such changes and the Terms of Use as modified thereby. ACCOUNTS

You must be a registered MY HUGO BOSS EXPERIENCE member  in order to use the BOSS UNBOXED program. If you do not have a MY HUGO BOSS EXPERIENCE account (“Account”) you may create an account here: https://www.hugoboss.com/us/registration. Please also keep your MY HUGO BOSS EXPERIENCE information confidential. If someone accesses our Services using your Account, we will rely on that information and will assume that it is really you or someone you have authorized who is accessing the Services. You are solely responsible for any and all use of your Account and all activities (including orders placed through the Services) that occur under or in connection with your Account.

APPOINTMENTS & SHIPMENTS

BOSS UNBOXED Shipments. When you utilize the Services, we will set up a an appointment with a sales associate, which may be virtual, via e-mail or over the phone.The associate will contact you regarding your preferences and may both pre-select some Products and select Products during the  appointment to present to you during the  appointment. The sales associate will then send you the Products,. Available ship dates are determined at our discretion and may vary based on a variety of factors, including without limitation inventory, geography, and mode of delivery. You will have 3 calendar days from the delivery date of the Product to try on the Products to determine if you would like to keep them (“Try On Period”). You can decide to keep all, some, or none of the Products in the shipment, and we will charge you for the items you keep as described in the Payment section (below). If Products are not returned (i.e. the Store does not receive the product) after 5 calendar days from the date we shipped the product, you will be charged in accordance with the Payment Section, below.

By participating in the BOSS UNBOXED Program, you authorize us to charge you for the Products in accordance with these Terms of Use. We may refuse to ship to any address for any reason including because it is outside the geographic area that we serve or it is to an address that we determine may be associated with fraudulent purchases. We reserve the right to limit quantities purchased by Clients.

Sending Back Products During the Try-On Period.

If you want to send back any of the Products during the Try On Period, simply place them in the original package using the return label provided and mail them back to us at no cost to you. Any Products sent back must be registered with the overnight carrier service or delivery and received by us within  5 calendar days from the date we originally shipped the product to you. (, All returns must be unworn, unaltered, contain the original tags, and be in original condition . You will retain title to the Products and risk of loss of the Products will remain with you until we receive the Products and we determine that the Products were returned unworn, in their original condition and in accordance with these Terms and Conditions, at which point you will be deemed to have rejected the Products and title will return to us. We will assume that you have chosen to keep any Products that are not received by us by the end of the Try-On Period, and we will  charge you for those Products any time after the end of the Try-On Period in accordance with the Payment section, below.

All Products will be deemed accepted by you upon shipment, and title to and risk of loss passes to you when we provide the Products to a common carrier.

PAYMENTS

After your virtual appointment but before the Products are shipped, you will receive an e-mail outlining the Products you selected with a secure link to input your payment information and the estimated sales tax (“Pay-by Link”). Your items will not be shipped until payment information is completed. At the time of shipment we will place a hold on your credit card for the full amount of your order plus estimated tax, but your credit card will not be charged. At the end of the Try-on Period any items which have not been returned to HUGO BOSS in the condition set forth above and the estimated tax, adjusted for the tax applicable in the location to which the Products were shipped will be charged to the credit card that you provided in the Pay-by Link.  By submitting your payment information to us, you authorize us to charge your credit card or other payment method then available in accordance with these Terms.

You represent that you will not use any credit card or other form of payment unless you have all necessary authorization to do so. We will not be liable in the event your children or others acting with or without your permission use your credit card, or other means of payment to make orders on the Services. HUGO BOSS gift cards are not redeemable for UNBOXED purchases.

RETURNS

Once you have accepted an item or you fail to return any items within the time frame setforth above, our Return policy will apply. RIGHT TO SUSPEND

HUGO BOSS reserves the right, in our sole discretion, to suspend your Account or your use of the Services at any time,  including without limitation when deemed necessary to protect the security or operation of the Services.

FEEDBACK

In the event that you provide us any ideas, thoughts, criticisms, suggested improvements or other feedback related to Products or the Services (collectively “Feedback”), you agree we may use the Feedback to: (a) improve our Services or any Products and (b) promote the Services and Products, and that you will not be due any compensation for your Feedback that is used in these ways. To the extent that you provide your name, likeness, or voice, this will be part of the Feedback and you agree that we may use your name, likeness and voice in the same manner that we can use other Feedback. You grant to us a worldwide, royalty-free, fully paid, perpetual, irrevocable license to use, reproduce, modify, translate, distribute, perform, display, import, sell, offer for sale, make, have made and otherwise exploit the Feedback in any form, media, or technology, whether now known or hereafter developed, and to allow others to do the same. This is true whether you provide the Feedback on the Services or through any other method of communication with us, unless we have entered into a separate agreement with you that provides otherwise.

MODIFICATIONS TO THE SERVICES

We reserve the right to modify or discontinue the Services with or without notice to you. We will not be liable to you or any third party should we exercise our right to modify or discontinue the Services. If you object to any such changes, your sole recourse will be to cease access to the Services. Continued access to the Services following notice of any such changes will indicate your acknowledgement of such changes and satisfaction with the Services as so modified. You agree that we, in our sole discretion, may immediately terminate your access to the Services at any time, for any reason, in our sole discretion. You agree that we will not be liable to you or any other party for any termination of your access to the Services.
